What does the bank have a right to
On requesting a loan, we are concerned with our own priorities without bearing in mind that the creditor has others. Although it is protected in various aspects, there are three main ones.
From the moment we sit down in front of the professional at the banking institution from which we wish to request the loan, we receive a great deal of data and documents. And at times, we spend so much time on these that we forget that the bank also has its rights. Let us find out, then, what these are.
Effectiveness of the mortgage
This is achieved through so called mortgage property legal action, consisting of bringing about the sale of the mortgaged asset, if the debtor does not pay, in order to pay with the money from the sale. In this regard, it would be null if the bank takes possession of the property, even when both parties reach an agreement.
Conservation of the mortgaged property
Despite all of this, the buyer should not forget that the mortgage loan allows them to occupy and enjoy their home without having paid for it and, even, without having the money to do so. This may make the banking or financial institution see its right of payment prejudiced, since the buyer may diminish the value of the property, damaging it through inappropriate conduct. For this reason, the creditor has the right to request judge to adopt the necessary measures to prevent or, at least, to solve it. If the buyer were to continue with this incorrect conduct, the creditor could even place the property under judicial administration.
Priority over other creditors
If the mortgaged buyer cannot meet the payments of the mortgage and, in turn, has debts with other people or institutions, the mortgage loan creditor would have preference to recover payment with the property. It should be pointed out that in this case there may be exceptions.
